These terms of use govern your access to and use of the Advanced Informatics website. By accessing or using the Site, you confirm that you accept these Terms and agree to comply with them. If you do not agree to these Terms, you must not use the Site.

1. About us and these terms

1.1 This website at advancedinformatics.co.uk (the "Site") is operated by Advanced Informatics Ltd ("Advanced Informatics", "we", "us", "our"), a private limited company registered in England and Wales under company number 11479544 (VAT registration number GB 304 3352 45), with its registered office at 58 Tamworth Road, Long Eaton, Nottingham, Derbyshire, NG10 3LW.

1.2 These terms of use (the "Terms") govern your access to and use of the Site. By accessing or using the Site, you confirm that you accept these Terms and agree to comply with them. If you do not agree to these Terms, you must not use the Site.

1.3 Our Site is intended for businesses and professional contacts. Our services are provided to clients only under a separate written agreement; nothing on the Site forms part of, varies, or is incorporated into any such agreement (see clause 5).

1.4 If you use the Site on behalf of an organisation, you confirm that you have authority to accept these Terms on that organisation's behalf, and "you" and "your" refer to that organisation.

1.5 We recommend that you print or save a copy of these Terms for your records.

1.6 In these Terms, a "consumer" means an individual acting for purposes that are wholly or mainly outside that individual's trade, business, craft or profession (within the meaning of section 2(3) of the Consumer Rights Act 2015); a "business user" means any other user, including anyone using the Site in the course of a business or on behalf of an organisation.

2. Using our website

2.1 You may access the Site free of charge. We do not guarantee that the Site, or any content on it, will always be available or uninterrupted (see clause 6).

2.2 We grant you a limited, non-exclusive, revocable licence to access the Site and to view, download and print pages from it for your own internal business purposes or personal reference only. This licence does not permit any commercial exploitation of the Site or its content except as expressly permitted by these Terms.

2.3 You are responsible for making all arrangements necessary to access the Site, and for ensuring that anyone who accesses the Site through your internet connection is aware of these Terms and complies with them.

3. Acceptable use

3.1 You may use the Site only for lawful purposes. You must not use the Site:

(a) in any way that breaches any applicable local, national or international law or regulation;

(b) in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;

(c) to gain or attempt to gain unauthorised access to the Site, the server on which it is stored, or any server, computer or database connected to it;

(d) to introduce any viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful (see clause 8);

(e) to attack the Site via a denial-of-service attack or a distributed denial-of-service attack;

(f) to collect or harvest data from the Site, including by scraping or other automated means, without our prior written consent (a search engine may index the Site in accordance with the instructions we publish for that purpose);

(g) to send, through the Site's contact form or otherwise, any unlawful, defamatory, obscene, or unsolicited promotional material; or

(h) to reproduce, duplicate, copy, or re-sell any part of the Site except as expressly permitted by these Terms.

3.2 Good-faith security research. Nothing in clause 3.1 is intended to prohibit, and we will not treat as a breach of these Terms, security research and vulnerability reporting carried out in good faith and in accordance with our Vulnerability Disclosure Policy where we have published one, or otherwise in accordance with responsible coordinated-disclosure practice. If you believe you have found a security vulnerability, please report it as set out in that policy (or, if none is published, by email to enquiries@advancedinformatics.co.uk) rather than test or exploit it further.

3.3 We may suspend or end your access to the Site if you breach this clause 3 or any other part of these Terms.

4. Intellectual property

4.1 We are the owner or the licensee of all intellectual property rights in the Site and in the material published on it, including its text, graphics, design, layout, and the "Advanced Informatics" name and logo (together, the "Content"). These rights are protected by copyright and other laws. All such rights are reserved.

4.2 Subject to the licence in clause 2.2, you must not use any Content without our prior written permission. In particular, you must not copy, modify, distribute, republish, or commercially exploit any Content.

4.3 Any trademarks, product names or logos of third parties that appear on the Site (for example, in a case study) are the property of their respective owners and are used with permission or for identification only; their appearance does not imply any endorsement by, or association with, those owners.

4.4 If you print, copy or download any part of the Site in breach of these Terms, your right to use the Site will cease immediately and you must delete or destroy any copies you have made.

4.5 Nothing in these Terms prevents or restricts any use of the Content that cannot lawfully be prevented or restricted by contract, including any act permitted under an exception in the Copyright, Designs and Patents Act 1988 (for example, copying for text and data analysis for the sole purpose of non-commercial research by a person with lawful access, under section 29A).

5. No advice and no reliance

5.1 The Content is provided for general information only. It is not intended to amount to advice on which you should rely, and it does not constitute technical, professional, legal, financial or other advice.

5.2 Nothing on the Site constitutes an offer, an invitation to treat, or a binding commitment by us, and nothing on the Site forms part of any contract. Any engagement of our services is subject to a separate written agreement between us and the client; in the event of any conflict, that agreement prevails over the Site and these Terms in respect of the services.

5.3 Although we make reasonable efforts to keep the Content up to date, we make no representations, warranties or guarantees, whether express or implied, that the Content is accurate, complete or current. Any reliance you place on the Content is at your own risk, subject to clause 9.

6. Availability and no warranty

6.1 The Site is made available "as is" and "as available". We do not guarantee that the Site, or any content on it, will always be available, uninterrupted, timely, secure or free from errors.

6.2 We may suspend, withdraw, discontinue or change all or any part of the Site without notice. We will not be liable to you if for any reason the Site is unavailable at any time or for any period, subject to clause 9.

6.3 We do not warrant that the Site will be compatible with your hardware or software.

7. Links to and from our website

7.1 Where the Site contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources, and such links do not signify that we endorse them. We are not responsible for any loss or damage that may arise from your use of them (see clause 9).

7.2 You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in a way that suggests any form of association, approval or endorsement on our part where none exists. You must not frame the Site on any other site, and you must not create a link to any part of the Site other than the home page, without our prior written consent. We may withdraw linking permission at any time without notice.

8. Viruses and security

8.1 We do not guarantee that the Site will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programs and platform to access the Site, and you should use your own virus-protection software.

8.2 You must not misuse the Site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Site, the server on which it is stored, or any server, computer or database connected to it. A breach of this clause may be a criminal offence under the Computer Misuse Act 1990. We may report any such breach to the relevant law-enforcement authorities and cooperate with them, including by disclosing your identity to them in accordance with our Website Privacy and Cookie Policy and applicable data protection law, and your right to use the Site will cease immediately. Clause 3.2 (good-faith security research) applies to this clause; where it applies, we will deal with your report in accordance with our Vulnerability Disclosure Policy (where published), including its position on referral to law-enforcement authorities.

9. Our liability to you

9.1 Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for any other liability that cannot be excluded or limited under the law of England and Wales.

9.2 If you are a consumer: these Terms do not affect your statutory rights as a consumer, which cannot be excluded or limited by contract. Any exclusion or limitation of our liability in these Terms applies to you only to the extent permitted by law, including the Consumer Rights Act 2015.

9.3 If you are a business user:

(a) we exclude all implied conditions, warranties, representations or other terms that may apply to the Site or any Content on it, to the fullest extent permitted by law; and

(b) we will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with the use of, or inability to use, the Site, or the use of or reliance on any Content - including, without limitation, any loss of profits, loss of business, business interruption, loss of anticipated savings, or loss of business opportunity, and any indirect or consequential loss.

9.4 This clause 9 does not affect any liability we may have to a client under a separate written agreement for our services, which is governed by the terms of that agreement.

10.1 We only use personal data collected through the Site as set out in our Website Privacy and Cookie Policy, which is available on the Site. Please review it to understand how we handle your personal data and how we use cookies and similar technologies.

11. Changes to our website and these terms

11.1 We may update and change the Site and the Content from time to time to reflect changes to our services, our users' needs, or our business priorities.

11.2 We may revise these Terms from time to time to reflect changes in our services, our business, or the law, or for security, legal or regulatory reasons. The revised Terms apply to your use of the Site from the date they are posted on this page; the "last updated" date at the top shows when these Terms were last revised. We will take reasonable steps to bring any significant change to the attention of returning users, and we encourage you to check this page from time to time.

12. General

12.1 If any provision of these Terms is found by a court or other competent authority to be invalid or unenforceable, that provision is severed and the remaining provisions continue in full force and effect.

12.2 Except as expressly stated, these Terms do not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of these Terms; this does not affect any right or remedy that exists apart from that Act.

12.3 Our failure or delay in enforcing any provision of these Terms is not a waiver of that or any other provision.

13. Governing law and jurisdiction

13.1 These Terms, their subject matter and their formation (and any non-contractual disputes or claims arising out of or in connection with them) are governed by the law of England and Wales.

13.2 If you are a business user, you and we agree that the courts of England and Wales have exclusive jurisdiction over any dispute or claim arising out of or in connection with these Terms or their subject matter or formation.

13.3 If you are a consumer, the courts of England and Wales have jurisdiction, but nothing in this clause affects any statutory right you may have to bring proceedings in the courts of your place of residence under the law that applies to you.
